Medical Malpractice

Over the past several years, we have taken keen interest in medical mal-practice litigation. We have handled (labour and delivery) cases arising out of injuries at birth, cases involving misdiagnosis, and cases involving injuries on the football field.

We continue to grow and develop our expertise in this complex area of the law.

Motor Vehicle Accidents

We pride ourselves in offering assistance to victims of motor vehicle accidents. We are there for you if you have been injured in an accident. We assist our clients in navigating the complex process of asserting claims for the no-fault accident benefits to which they are entitled in Ontario by law.

We assist you in completing the paperwork that is necessary, negotiating with the Accident Benefits Adjusters, making applications for catastrophic impairment where warranted, and attending Tribunal hearings, if compelled to do so. We do not get paid until we win your case.

Motor Vehicle Accidents

Immigration

We offer services in every area of Immigration and Refugee Law. Davies Bagambiire distinguished himself as a renowned Immigration lawyer in the 1980s, before he left Nova Scotia to relocate to Ontario. The writing of major text book, Canadian Immigration and Refugee Law, raised his profile in the field even higher, and led to his recognition as a leading lawyer in the area of Immigration and Refugee Law.

The firm focuses on immigrants from different parts of the world including the African countries, Bangladesh, West Indies, Philippines, and China.

Human Rights

Davies Bagambiire has been a leader in the area of human rights for over forty years. He acted as lead counsel for the Parent Student Association of Preston (PSAP), and an organization that was created in 1988 following the outbreak of racial violence at Cole Harbour District School, at the time the largest school in Nova Scotia.

The school broke out into physical fights between White and Black students, which lasted over three days. As lead counsel Davies Bagambiire both aggressively defended the Black students who had been charged criminally, and also worked with PSAP championing the demand for equality, justice and human rights in education in Nova Scotia. Davies Bagambiire acted as counsel for the complainants in several ground breaking cases in the areas of human rights which include:

 

  • Downey v. Metropolitan Transit Commission [1991] N.S.H.R.B.I.D. No. 1; Premakumar v. Air Canada, 2002 CanLII 23561 (CHRT)-2002-02-04
  • Nassiah v. Peel (Regional Municipality) Services Board, 2007 HRTO 14 (CanLII)-2007-05-11

Human Rights
